A block of flats - some of the flats are owner occupied and some are rented. Communal area falls under Landlord jurisdiction. What are the legal responsibilities for smoke alarms in the flats? Are we correct in thinking a) smoke alarms must be installed in the rented flats, and b) there is no legal requirement for the people living in the owner occupied flats to have any smoke alarms at all (it is their choice)? AnthonyB Posted March 22, 2021 Report Posted March 22, 2021 Assuming no communal provision and looking at them just as dwellings then, if not in Scotland, an owner occupier does not have to have any unless required by Building Regulations (which as lofts are converted, buildings are rewired and the proportion of post 1990 builds in use increases means more and more owner occupied homes will have them fitted). In Scotland it matters not if your house hasn't changed in 60 years, their law is retrospective. Rentals of course have mandatory provision. Quote
